The minutes of the Fairmont City Council meeting held on March 28, 2011, in the City Council Chambers. Mayor Randy Quiring called the meeting to order at 5:30 p.m. Council members Clerc, Gorath, Kallemeyn, Lucas and Rahm were present. Also in attendance: City Administrator Jim Zarling; Assistant City Administrator Mike Humpal; City Attorney Elizabeth Bloomquist; Public Works Director/City Engineer Troy Nemmers; Police Chief Greg Brolsma; and City Clerk Susan Olson. It was moved by Council member Lucas, seconded by Council member Clerc and carried to approve the minutes of the regular City Council meeting on March 14, 2011. There were no comments received by the City Council during Open Discussion. Mayor Quiring read a proclamation proclaiming Friday, April 1, 2011, as “National Exchange Club Day” in the City of Fairmont. On March 24, 2011, the City held a public auction to sell 163.32 acres more or less of agricultural real property. According to the City Charter, a public hearing must be held before the Council can take action on the proposed ordinance to sell the property. Mayor Quiring opened the public hearing to receive input on Ordinance No. 2011-06. There being no one present to be heard, a motion was made by Council member Lucas, seconded by Council member Clerc and carried to close the public hearing. Council member Clerc introduced and moved for the adoption of Ordinance No. 2011-06 approving the sale of 163.32 acres more or less of agricultural real property. Council member Rahm seconded the motion for its adoption. On roll call: Council members Clerc, Gorath, Kallemeyn, Lucas, and Rahm all voted aye. No one voted nay. Mayor Quiring declared said ordinance to have received the affirmative vote of the entire Council and he then declared the same to have been duly passed, approved, and adopted. The “Beyond The Yellow Ribbon” citizens committee requested Council approval to hold a military parade in honor of our local National Guard unit before they are deployed overseas. A motion was made by Council member Lucas, seconded by Council member Gorath and carried to approve the parade permit. The event will be held on Sunday, May 15, 2011, at 12:00 noon. The United Methodist Church requested Council approval to hold a “Way of the Cross Prayer Walk” on Good Friday, April 22, 2011. A motion was made by Council member Rahm, seconded by Council member Kallemeyn and carried to approve this parade permit. The MS Society requested Council approval to hold their annual “MS Walk”on Sunday, May 1, 2011 beginning at 10:00 a.m. A motion was made by Council member Clerc, seconded by Council member Lucas and carried to approve this parade permit. The Casey’s General Store, Inc. has purchased the NuWay Convenience Store located at 2237 North State Street and submitted an application to sell tobacco products at this location. A motion was made by Council member Kallemeyn, seconded by Council member Lucas and carried to approve this cigarette license application. The license will take effect April 1, 2011 and expire on December 31, 2011. Casey’s General Store, Inc. submitted an application for a 3.2% off sale beer license for their new location at 2237 North State Street. A motion was made by Council member Lucas, seconded by Council member Rahm and carried to approve a 3.2% off sale beer license effective April 1, 2011 with an expiration date of June 30, 2011. The Veterans of Foreign Wars Post 1222 is the organizer of this year’s Memorial Day parade. They have requested Council approval of their application for a parade permit for this event to be held on May 30, 2011. A motion was made by Council member Gorath, seconded by Council member Rahm and carried to approve this parade permit. Council members were informed of the annual Board of Equalization meeting scheduled for Wednesday, April 27, 2011, beginning at 9:00 a.m. Independent School District #2752 submitted a written offer to the City of Fairmont to sell the Lincoln School building to the City for $1.00. A motion was made by Council member Rahm, seconded by Council member Lucas and carried to decline the offer from the School District to purchase the Lincoln School building. The City of Fairmont has received a proposal from Bolton & Menk, Inc. for final design and preparation of bid documents for the Winnebago Avenue Recreational Facility. A motion was made by Council member Clerc, seconded by Council member Kallemeyn and carried to approve an agreement with Bolton & Menk, Inc. for a not-to-exceed fee of $46,200.00. As part of the process to sell the power plant and the adjacent lands to SMMPA, City Attorney Bloomquist presented an Indemnification Agreement and an Escrow Agreement with First American Title Insurance Company for City Council approval. A motion was made by Council member Kallemeyn, seconded by Council member Gorath and carried to approve these agreements with First American Title Insurance Company. A motion was made by Council member Gorath, seconded by Council member Rahm and carried to approve payment of the bills for the month of March, 2011 in the amount of $820,034.77.
