The minutes of the Fairmont City Council meeting held on April 9, 2012, at the City Hall Council Chambers. Mayor Randy J. Quiring called the meeting to order at 5:30 p.m. Council members Clerc, Gorath, Kallemeyn, Lucas and Rahm were present. Also in attendance: City Administrator Jim Zarling; Assistant City Administrator Mike Humpal; Public Works Director/City Engineer Troy Nemmers; Finance Director Paul Hoye; Police Chief Greg Brolsma; and City Clerk Susan Olson. It was moved by Council member Lucas, seconded by Council member Clerc and carried to approve the minutes of the regular City Council meeting of March 26, 2012. The following comment(s) were received by the City Council during Open Discussion: o Councilor Gorath reminded everyone the tree dump is only for disposal of trees, tree branches, bushes and shrubs. The compost area is only for disposal of leaves and grass clippings. Abuse of these areas has been reported. If the abuse continues, the end result may be to close these areas to public use. o Councilor Gorath suggested a “Free Compost Day” to encourage citizens to use the compost from the compost site. o Public Works Director/City Engineer Nemmers announced Winnebago Avenue, from Prairie Avenue to Orient Street, would be closed to traffic on Wednesday, April 11th, and limited access only on Thursday and Friday, April 12th and 13th. o Public Works Director/City Engineer Nemmers announced the road on the south side of the Water Plant leading down to the back of the Plant and also the fishing area in the back of the Water Plant will be closed for the next two years. At their meeting on April 3, 2012, the Planning Commission voted to recommend approval to the City Council of a request to rezone the property at 1200 North Park Street (Lincoln School) from an R-1 Single Family Residential District to a B-1 Neighborhood Business District. Before the Council can take action on this request, they must hold a public hearing offering citizens an opportunity to speak to this rezoning. A motion was made by Council member Clerc, seconded by Council member Lucas and carried to call for this public hearing to be held on Monday, April 23, 2012 at 5:30 p.m. In 2007/2008, the Planning Commission and the City Council approved a conditional use permit to the Marina Lodge Development Group for a planned unit development to be built at 501 Lake Avenue. The conditional use permit expired because no construction took place. At their April 3rd meeting, the Planning Commission voted to once again approve this conditional use permit for the planned unit development which would include eleven (11) units of mixed residential/commercial space. A motion was made by Council member Lucas, seconded by Council member Rahm and carried to approve this conditional use permit. The Fairmont Opera House applied for a one to four day temporary on sale liquor license for an event to be held on Friday, April 27, 2012. A motion was made by Council member Kallemeyn, seconded by Council member Gorath and carried to approve the temporary on sale liquor license application. Annually, the owner of the Fairmont Raceway, applies for a 3.2% on sale malt beverage license. Mr. Gary Jacobsen, the new owner of the race track, has applied for the license allowing him to sell 3.2% malt liquor from April 1, 2012 through October 31, 2012. A motion was made by Council member Rahm, seconded by Council member Lucas and carried to approve this 3.2% on sale malt beverage license. Late last fall, the City Council increased fees for sidewalk snow removal. The Council indicated they would also like to increase the fees for lawn mowing in order to encourage property owners to maintain their own lawns. Council member Lucas introduced and moved for the adoption of Resolution No. 2012-15 setting an administrative fee of $25.00 for the first time the property is mowed by the City and an additional $10.00 for each additional time the City mows the same property. Council member Rahm seconded the motion for its adoption. On roll call: Council members Rahm, Clerc, Gorath, Kallemeyn and Lucas all voted aye. No one voted nay. Mayor Quiring declared said resolution to have received the affirmative vote of the entire Council and he then declared the same to have been duly passed, approved and adopted. In 2011, the City was awarded a grant through the Safe Routes to School infrastructure grant program. The City will be receiving approximately $124,000 in 2012 to implement infrastructure improvements in and around Fairmont Elementary School which will include the following: a gap in the sidewalk system along South Orient Street from Adams Avenue to the Fairmont Elementary School; existing intersections with ADA compliant pedestrian ramps and crosswalk markings and associated signage to increase visibility along Grant Street, South Orient Street and State Street in select locations between Blue Earth Avenue and State Street; and a pedestrian refuge median on State Street at its intersection with South Orient Street. A motion was made by Council member Kallemeyn, seconded by Council member Lucas and carried to approve a contract with Bolton & Menk, Inc. to provide preliminary engineer services for the 2012 Safe Routes to School projects.
