The minutes of the Fairmont City Council meeting held on Monday, July 9, 2007 in the City Hall Council Chambers. Mayor Quiring called the meeting to order at 5:30 P.M. Councilmembers Anderson, Gorath, and Lucas were present. It was determined that a quorum was present. Also in attendance were City Administrator Zarling, Asst. City Administrator Humpal, City Attorney Bloomquist, and Police Chief Broslma. It was moved by Councilmember Lucas, seconded by Councilmember Gorath and carried to approve the minutes of the June 25, 2007, City Council meeting as presented. In open discussion, Gary Reutzel, Fairmont VFW Commander, and James Freeman, Sgt. from the Fairmont/Jackson National Guard, reminded the Council of the Troops homecoming this month and reported on the homecoming celebration. Mayor Quiring opened the public hearing regarding the vacation of Home Street, between vacated Fifth Street and Fourth Street. After all present were heard, it was moved by Councilmember Gorath, seconded by Councilmember Lucas, and carried to close the public hearing. It was moved by Councilmember Anderson, seconded by Councilmember Gorath and carried to approve the vacation of Home Street between vacated Fifth Street and Fourth Street with an easement for the existing watermain, which cuts across the southeast corner of Home Street. It was moved by Councilmember Gorath, seconded by Councilmember Anderson and carried to approve a dance permit for August 4, 2007 for the Fairmont Jaycees, pending receipt of proper fees. It was moved by Councilmember Lucas, seconded by Councilmember Gorath and carried to approve a temporary beer permit for the Fairmont Jaycees dance on August 4, 2007, pending receipt of proper fees. It was moved by Councilmember Lucas, seconded by Councilmember Gorath and carried to approve a temporary beer license for the Fairmont Jaycees at the Martin County Fair, August 14, 2007 through August 19, 2007, pending receipt of the proper fees. It was moved by Councilmember Anderson, seconded by Councilmember Gorath and carried to approve a cigarette license for the Fairmont Jaycees at the Martin County Fair, August 14, 2007 through August 19, 2007, pending receipt of the proper fees. Councilmember Lucas introduced and moved for the adoption of Resolution No. 2007-22, a resolution approving the low bid of Pearson Bros., Inc. from Hanover, Minnesota in the amount of $81,500.00 for the 2007-C sealcoat project. Councilmember Anderson seconded the motion for its adoption. On roll call, Councilmember Gorath, Lucas, and Anderson voted aye and no one voted nay. Mayor Quiring declared said resolution to have received the affirmative vote of the entire Council and he then declared the same to have been duly passed, approved and adopted. It was moved by Councilmember Anderson, seconded by Councilmember Gorath and carried to offer Ordinance No. 2007-03, an ordinance proposing to extend the hours of sale of intoxicating liquor on Sundays from 12:00 P.M. (Noon) to 10:00 A.M., and to call for a public hearing on July 23, 2007 at 5:30 P.M. to consider the proposed hours. It was moved by Councilmember Anderson, seconded by Councilmember Gorath and carried to authorize City Staff to advertise for bids for remodeling at the Southern Minnesota Educational Campus. It was moved by Councilmember Lucas, seconded by Councilmember Gorath and carried to offer Ordinance No. 2007-04, an ordinance calling for the sale of the old sludge lagoons, previously declared to be excess property, and to call for a public hearing on July 23, 2007 at 5:30 P.M. to consider the sale. It was moved by Councilmember Anderson, seconded by Councilmember Lucas and carried to offer Ordinance No. 2007-05, an ordinance calling for the adoption of the updated 2007 Minnesota State Building Code, and to call for a public hearing on July 23, 2007 at 5:30 P.M. to consider the adoption. It was moved by Councilmember Anderson, seconded by Councilmember Gorath and carried to amend City Personnel Policy #36 Sick Leave, to clarify that sick leave benefits apply to permanent full-time employees only. It was moved by Councilmember Lucas, seconded by Councilmember Gorath and carried to amend City Personnel Policy# 39 Vacation, to clarify that vacation benefits apply to permanent full-time employees only. As an appreciation gesture, the Council approved to provide the returning military troops and their families a free family pass to the Fairmont Aquatic Park for the remainder of the 2007 season.
