Minutes of the Fairmont City Council meeting held on July 12, 2010, in the City Hall Council Chambers. Mayor Randy Quiring called the meeting to order at 5:30 p.m. Council members Anderson, Gorath and Lucas were present. Council members Clerc and Kallemeyn were absent. Also in attendance were: City Administrator Jim Zarling; Assistant City Administrator Mike Humpal; City Attorney Elizabeth Bloomquist; Finance Director Paul Hoye; Police Chief Greg Brolsma; and City Clerk Susan Olson. It was moved by Council member Gorath, seconded by Council member Anderson and carried to approve the minutes of the June 28, 2010 City Council meeting as presented. The following comment(s) were received by the City Council during Open Discussion: o Jim Bock, representing the Martin and Faribault County Habitat for Humanity, addressed the Council to request that the building permit fee and the sewer and water hook-up fees (totaling approximately $1,500), assessed to their latest project, be excused. Following discussion, the Council agreed to deny approval of this request. o Council member Lucas requested Public Works Director/City Engineer Nemmers present a report at the July 26, 2010 Council meeting concerning the process involved in seal coating our streets. The owners of the Lake Sisseton Saloon have requested an amendment to their current on sale liquor license allowing them to expand their premise to include an outdoor area where, during the summer months, they hold outdoor activities. A motion was made by Council member Anderson, seconded by Council member Gorath and carried to approve this request to expand the premise conditioned on a fence being erected around the perimeter of the area each time an event is held. The manager of the Holiday Inn/Green Mill Restaurant has requested an amendment to their current on sale liquor license to allow them to expand their premise to include a fenced in outdoor area to be used for special events during the summer months. A motion was made by Council member Lucas, seconded by Council member Anderson and carried to approve this request for an expansion of their premise as described in their on sale liquor license. Lenny Tvedten, Executive Director of the Martin County Historical Society, addressed the City Council to request that the building permit fee for the remodeling of the parsonage in the amount of $389.25 be excused. Following Council discussion, a motion was made by Council member Anderson, seconded by Council member Lucas and carried to deny the request from the Martin County Historical Society. Included in the City’s Personnel Policy, is a policy on internet usage. Because of changes in technology, the League of Minnesota Cities Insurance Trust has recommended Policy No. 82 be expanded and updated. A motion was made by Council member Gorath, seconded by Council member Anderson and carried to adopt the amended City of Fairmont Computer Use Policy No. 82. The League of Minnesota Cities Insurance Trust has recommended a formal Cellular Telephone policy be adopted. A motion was made by Council member Lucas, seconded by Council member Anderson and carried to adopt Personnel Policy No. 84, Cellular Telephone Policy. The League of Minnesota Cities Insurance Trust has recommended the City adopt formal guidelines for electronic communications for Council members. A motion was made by Council member Anderson, seconded by Council member Gorath and carried to formally adopt the “Guidelines for Electronic Communications for Council Members”. As part of the process to reconstruction the Lair Road bridge, three consultants have been approached by City staff to complete the geotechnical exploration, design work, assistance with land acquisition, appraisals and lot surveys. The consultants and the bid amounts are as follows: Bolton & Menk, Inc. - $146,100; Erickson Engineering - $66,060; American Engineering & Testing - $6,000; miscellaneous expenses - $7,000. A motion was made by Council member Lucas, seconded by Council member Anderson and carried to approve these contracts for the Lair Road Bridge Project. The City of Fairmont’s Storm Water Pollution Prevention Plan and MS4 Permit requires the adoption of a Storm Water Management Ordinance. A public hearing must be held before the City Council can adopt this proposed ordinance. A motion was made by Council member Anderson, seconded by Council member Gorath and carried to call for a public hearing to be held on Monday, July 26, 2010. Because a vacancy exists on the Public Utilities Commission, Mayor Quiring recommended the appointment of Jeff Vetter of 516 South Valley View Court to fill this vacancy. A motion was made by Council member Gorath, seconded by Council member Lucas and carried to approve this appointment to the Public Utilities Commission. His term will expire on January 31, 2013.
